Scope

These General Conditions of Sale (CGV) govern the relationship between the seller and any natural or legal person (the Customer) wishing to purchase one or more Maholi products sold (the Products).

Products

The Products offered by the seller are described on its website. The seller reserves the right to modify the characteristics, prices and availability of the Products at any time.

Order

The Customer can order the Products online on the Maholi website. The order will be final after validation by the Customer of the basket and payment.

Price and payment

The prices of the Products are indicated in euros, all taxes included, excluding delivery costs. Delivery costs are the responsibility of the Customer and are indicated when ordering, except from a certain basket amount previously communicated on the website.

Payment is made online at the time of ordering by credit card or any other means of payment offered on the site.

Delivery

The Products are delivered to the address indicated by the Customer when ordering. Delivery times are indicated on the order validation email and may vary depending on the Products ordered and the delivery destination.

Billing and shipping addresses may be different.

The delivery address must be in France, Switzerland, Germany, the Netherlands, Luxembourg or Belgium.

For all deliveries within the European Union, outside mainland France, each order will be processed individually. The seller must be contacted.

In the event of late delivery, the Customer will be informed as soon as possible. In the event of non-delivery within the expected deadlines, the Customer may cancel his order and obtain a refund of the sums paid within 30 days from the date of the order.

Withdrawal and returns

In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from receipt of the Products to exercise his right of withdrawal without having to provide reasons or pay penalties. The costs of returning the Products are the responsibility of the Customer.

The Products must be returned in their original packaging and in perfect resalable condition. Maholi reserves the right to refuse any returns in the event of damage to the Products or their packaging.

Guarantees and liability

Maholi guarantees that the Products conform to their description on the website. In the event of non-compliance, the Customer may request replacement or reimbursement of the Products.

The seller points out that the products sold are neither medical nor pharmaceutical products and that they fall into the well-being category.

Intellectual Property Rights

All products marketed under the Maholi brand correspond to trademarks, logos, trade names and distinctive signs associated with Maholi are the exclusive property of Adèle Bouscasse and are protected by national trademark laws. No right or license is granted to the customer regarding the use of these brands, logos, trade names and distinctive signs.

Use of products

The products sold by Maholi are intended for use as described in the product sheet attached when sent. The customer is not authorized to reproduce, copy, modify or distribute the products.

Responsibility

In no event shall Seller be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use or inability to use the Products.

Force majeure

Force majeure or fortuitous cases such as: total or partial strikes hindering the smooth running of our company or that of one of our suppliers, subcontractors or carriers, as well as the interruption of transport, the supply of energy, raw materials or spare parts, have the effect of suspending our contractual obligations.

In the event of a dispute between the customer and the seller, the customer already agrees to give jurisdiction to the Lyon courts to handle the dispute.
